These Terms of Service ("Terms") govern your access to and use of the Performations service, websites, and related content (the "Service"), operated by Arkitect Holdings LLC ("Performations," "we," "us," or "our"). By using the Service or subscribing, you agree to these Terms.
Performations provides personalized guided-audio sessions and related content for general performance and well-being purposes. The Service is delivered on a recurring basis to subscribers, including by text message to those who opt in.
You must be at least 18 years old to use the Service or enter into a subscription. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
If you opt in to text messages, you agree to receive recurring automated messages from Performations, including session deliveries and account notifications. Message frequency varies (for example, around two messages per week). Message and data rates may apply.
The Service is provided for general well-being, relaxation, and performance support only. It is not medical, psychological, or therapeutic advice, diagnosis, or treatment, and is not a substitute for care from a qualified professional. Do not use the Service while driving or operating machinery, or in any situation requiring your full attention. If you have a medical or mental-health condition, consult a professional before use. If you experience distress, stop and seek appropriate support.
The Service and its content are licensed to you for personal, non-commercial use only. You may not copy, redistribute, resell, publicly perform, or create derivative works from the content, or attempt to access the Service in an unauthorized way.
All content, audio, voices, text, and materials provided through the Service are owned by or licensed to Arkitect Holdings LLC and are protected by applicable law. We grant you a limited, revocable, non-transferable license to access the content for personal use during your subscription.
The Service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Arkitect Holdings LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
We may update these Terms from time to time. Material changes will be posted here with an updated effective date, and continued use of the Service constitutes acceptance.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
